Terms for using the haklaf platform — a listings board for collectible cards

These Terms of Use govern your use of the haklaf platform (the “Platform”, the “Site”) — a listings board dedicated to collectible trading cards (Pokémon, One Piece, and additional games to be added). By browsing or using the Platform you agree to the terms below. If you do not agree to any term, please do not use the service.
1. Definitions
- “Platform Operator” — the entity operating the haklaf site. The Platform operates solely under the “haklaf” brand, with no personal identification of operators or staff.
- “User” — anyone who registers for the service, as a buyer, a seller, or both.
- “Listing” — an item offered for sale by a user: a single card, a bundle, a booster box, a graded item, a lot, etc.
- “Transaction” — any agreement, payment, shipment or handover carried out between a buyer and a seller, directly and without the Platform’s involvement.
2. Nature of the Service — a Listings Board Only
haklaf is a listings board acting solely as an intermediary. The Platform’s role is limited to displaying listings, providing search and filter tools, showing a live global market-price anchor as an indication only, and facilitating the initial contact between buyer and seller (the “interest” flow).
The Platform is not a party to any transaction between users. The Platform does not sell, buy, broker payment, guarantee, pre-vet, escrow, or manage any payment between the parties. Every transaction — including arranging a meeting, agreeing on a final price, the payment method, shipping, or handover — is carried out directly between the buyer and the seller, at their sole responsibility, outside of the Platform (for example over WhatsApp, at an in-person meeting, or via any other channel the parties choose).
3. Buyer and Seller Responsibility
Every aspect of a transaction — the item’s authenticity, condition, price, payment method, shipping, handover and safety at a meeting — is the sole responsibility of the buyer and the seller. Recommended, but no substitute for independent judgment:
- Inspect the item (photos, description, grading certificate number if applicable) before closing a deal.
- Prefer a safe in-person meeting for high-value items, and avoid prepaying an unfamiliar counterpart.
- Check the seller’s/buyer’s public profile rating and deal count.
- Exercise the same reasonable caution you would with any private purchase, online or offline.
The Platform does not inspect or verify the authenticity, quality, ownership, or legality of items offered in listings, and is not liable for any direct or indirect damage resulting from a transaction, including a transaction that fails to complete, a defective, counterfeit, misdescribed, or undelivered item.
A seller operating as a business (a “dealer” as defined in the Israeli Consumer Protection Law, 1981) bears sole responsibility for every duty the law imposes on them toward buyers. The Platform Operator is not a “dealer” selling the listed items and bears no seller obligations in any transaction.
4. Prohibited Content and Reporting Procedure
It is strictly prohibited to publish a listing that includes, in whole or in part:
- A counterfeit, replica, or fraudulently misrepresented card, product, or item.
- A stolen item, or an item the poster has no legal right to sell.
- False information about grade, condition, language, set, or card identity.
- Offensive, harassing, discriminatory content, or content infringing a third party’s rights (including intellectual property).
- Spam, repeated re-posting, or attempts to bypass the Platform’s contact mechanisms.
Reporting and removal procedure: any user may report a listing or user suspected of violating this section, via the report button on the listing page or profile. Reports are handled by the moderation team; the Platform may, at its sole discretion and without a duty to give the reporter detailed reasoning, remove a listing, suspend an account, or block a user — including temporarily pending review. The Platform’s decision in this matter is final and not subject to appeal within the service (without derogating from any rights a user has under law).
A rights holder — including in intellectual property — who is not a registered user may send a reasoned removal request to the contact address at the end of these Terms. A substantiated request will be handled by removing the infringing content within a reasonable time.
5. Conduct Rules
- Do not impersonate another person or entity, and do not create more than one active account per user.
- Provide an accurate nickname and region; city and phone details are used by the Platform only as described in the Privacy Policy.
- Do not harass, threaten, or act abusively toward other users, in communications through the Platform or elsewhere following contact made through it.
- Do not make unauthorized commercial use of Platform data (scraping, automated bulk requests, and the like).
6. Registration, Age, and Account
The service is intended for users aged 18 and over with the legal capacity to enter into transactions. Users are responsible for keeping their login credentials confidential and for any action taken through their account.
7. Suspension and Account Termination
The Platform Operator may, at any time and at its discretion, suspend or close a user account — in particular for violating these Terms, repeated reports, suspected counterfeiting or fraud, or activity that endangers other users. Users may request deletion of their account at any time, as described in the Privacy Policy.
8. User Content and Intellectual Property
A user posting a listing is responsible for ensuring they hold the legal right to publish the content (photos, descriptions) they upload. By posting content, the user grants the Platform a non-exclusive license, limited to the purpose of displaying the listing and operating the service (including in search results and the feed), until the listing is removed or the account is deleted — except for copies required for record-keeping, moderation, fraud prevention, and displaying sold-listing history, as described in the Privacy Policy.
9. Catalog Data, Prices, and Third-Party Intellectual Property
Card names, card numbers, set names, and official card images shown on the Platform are retrieved from public third-party catalog sources and remain the intellectual property of their respective rights holders (including Nintendo, The Pokémon Company, and Toei Animation). They are displayed solely to identify the items offered for sale. haklaf is an independent platform and is not affiliated with, sponsored, or endorsed by these entities. The price anchor and catalog data are provided as is, with no warranty of accuracy, currency, or availability, and do not constitute a recommendation or advice of any kind. A rights holder seeking removal of content may reach out as described in Section 4 above.
10. Disclaimer of Liability and Indemnification
The service is provided “AS IS”, with no warranty of continuous availability, price-data accuracy (which is an indication only, not investment advice), or freedom from errors. The Platform Operator is not liable for any direct, indirect, consequential, or special damage arising from use of the service, a transaction between users, or reliance on content posted by a user. Users agree to indemnify the Platform Operator for any claim, damage, or expense arising from a breach of these Terms or from their actions on the Platform.
The guides, calculators, and tools on the site (including the customs calculator and the grading-cost calculator) provide general information only and are not legal, tax, investment, or other professional advice. Reliance on them is at the user’s sole responsibility.
The Platform relies on external infrastructure and service providers (hosting, database, email, catalog and price sources). The Platform Operator is not liable for any failure, outage, or data loss originating with these providers or from circumstances beyond its reasonable control (force majeure). Without derogating from the above, should the Platform Operator nevertheless be held liable despite these Terms, its aggregate liability for all causes of action shall not exceed the amount the user paid the Platform in the 12 months preceding the event, and for a free service — ILS 100.
11. Privacy
The collection and processing of personal data is governed in full by the Platform’s Privacy Policy, which forms an integral part of these Terms.
12. Changes to These Terms
The Platform Operator may update these Terms from time to time. A material update will be published on the site with the update date noted; continued use of the service after an update constitutes acceptance of the updated Terms.
13. Governing Law, Jurisdiction, and Binding Version
These Terms and the use of the Platform are governed solely by the laws of the State of Israel. Exclusive jurisdiction over any dispute relating to the Platform lies with the competent courts of Israel. These Terms are published in Hebrew and in English; in case of any contradiction or inconsistency between the versions, the Hebrew version prevails.
